SAN DIEGO – A Florida-headquartered company is the defendant in a class-action lawsuit over allegations it unlawfully made marketing calls.
Christopher Melingonis filed a complaint on behalf of all others similarly situated on March 28 in the U.S. District Court for the Southern District of California against Social Agency Inc., also known as Local Hype 365, alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that in March, he received a call from the defendant. The plaintiff holds Social Agency Inc. responsible because the defendant called him allegedly without having the plaintiff's prior express consent or an established business relationship.
The plaintiff requests a trial by jury and seeks $500 in statutory damages, injunctive relief, $1,500 in treble damages, and any other relief as the court deems just.
