LOS ANGELES – A YouTube creator is seeking a declaration regarding his trademark.
Moroni Matteo filed a complaint on March 27 in the U.S. District Court for the Central District of California against Diego Dolciami Servettini and Does 1 through 10 seeking declaratory judgment.
According to the complaint, the plaintiff alleges that he is the rightful owner of the DM Pranks mark for clothing and other services. The suit states he uses the mark for his DM Pranks Productions YouTube channel and Facebook page. The defendant was hired by the plaintiff to help edit videos for the plaintiff's YouTube channels, the suit states. The plaintiff holds Servettini and Does 1 through 10 responsible because the defendants allegedly attempted to register the same mark as the plaintiff via international application.
The plaintiff seeks declaration that the he first used the mark, declare that the defendants' use of plaintiff's mark constitutes trademark infringement, declare that the defendant has no right to apply for federal registration for a similar mark, defendant's application should be canceled, all legal fees and any other relief as the court deems just.
