GCIU - Employer Retirement Fund alleges it is owed more than $420,000

LOS ANGELES – A multiemployer pension plan alleges a Virginia trade union failed to pay its withdrawal liability obligation.

GCIU - Employer Retirement Fund and board of trustees of the GCIU - Employer Retirement Fund filed a complaint on March 29 in the U.S. District Court for the Central District of California against GCC/IBT Local Union No. 670 - C, also doing business as Bellwood Printing Pressmen, Assistants and Specialty Union Local No. 670 - C, citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that the defendant was required to make contributions to the plaintiffs' fund per a bargaining agreement. It alleges the defendant withdrew from participating in the fund in 2014 and that the plaintiffs sent a notice and demand for payment in December 2015 for the withdrawal liability of $420,612. The defendant has allegedly failed to make this payment.

The plaintiffs seek past due liability payment of $420,612, interest, all legal fees, and any other relief as the court deems just. They are represented by Kerry K. Fennelly and Valentina S. Mindirgasova of Cornwell & Baldwin in Escondido.
