LOS ANGELES – A Santa Monica skin and body care products company claims another brand of beauty product is being sold under a confusingly similar name.
Counter Brands LLC filed a complaint on March 29 in the U.S. District Court for the Central District of California against The Happiness Group Inc., Nudu USA Inc., and Does 1 through 10 citing trademark infringement.
According to the complaint, the plaintiff alleges that it acquired the NUDE cosmetics brand in 2007. The plaintiff holds The Happiness Group Inc., Nudu USA Inc., and Does 1 through 10 responsible because the defendants allegedly sells their beauty products under the NUDU mark, which it claims is confusingly similar to the NUDE mark.
The plaintiff requests a trial by jury and seeks injunction against the defendants, to enjoin the defendants, order the defendants to abandon the NUDU application, actual damages, profits, punitive damages, all legal fees, interest, and any other relief as the court deems just.
