LOS ANGELES – An Oceanside employer is accused of failing to pay employee contributions to a labor union fund.
Board of trustees of the Tile Industry Health and Welfare Fund filed a complaint on March 30 in the U.S. District Court for the Central District of California, Western Division against RDM Tile Co. North Inc. alleging breach of written collective bargaining agreement.
According to the complaint, the plaintiff alleges that it suffered damages due to unpaid and late-paid contributions. The plaintiff holds RDM Tile Co. North Inc. responsible because the defendant allegedly breached its bargaining agreement with the plaintiff by failing to remit its employees' contribution.
The plaintiff seeks unpaid benefit contributions of at least $13,467.54, damages, prejudgment interest of $3,606.84, liquidated damages of at least $4,425.11, audit costs of $1,249.50, all legal fees and any other relief as the court deems just.
