O'Reilly Auto Parts employee alleges violations of labor codes regarding rest breaks

LOS ANGELES – An Apple Valley resident employed by an O'Reilly Auto Parts location has filed a class action over complaints that she was not given adequate meal and rest breaks.

Kia Davidson filed a complaint on behalf of other members of the general public similarly situated on March 29 in the U.S. District Court for the Central District of California against O'Reilly Auto Enterprises LLC, O'Reilly Auto Parts, CSK Auto Inc. and CKS Auto Parts citing California labor codes.

According to the complaint, the plaintiff alleges that she works full time at the defendants' San Bernardino location. The plaintiff holds O'Reilly Auto Enterprises, LLC, O'Reilly Auto Parts, CSK Auto, Inc., CKS Auto Parts responsible because the defendants allegedly failed to provide adequate rest and meal breaks to the plaintiff and failed to provide accurate wage statements.

The plaintiff requests a trial by jury and seeks actual, consequential and incidental damages and loss, interest, all legal fees and any other relief as the court deems just. She is represented by Matthew T. Theriault, Robert J. Drexler Jr. Bevin Allen Pike and Jonathan Lee of Capstone Law APC in Los Angeles.
