SAN FRANCISCO – Several labor union funds allege a general contractor failed to contributions on behalf of his employees.
Board of trustees of the Cement Masons Health and Welfare Trust Fund for Northern California, et al. filed a complaint on April 3 in the U.S. District Court for the Northern District of California against Timothy J. Stephan, doing business as Contract Installations, alleging breach of collective bargaining agreement.
The plaintiffs allege they suffered damages due to unpaid and late paid contributions from the defendant from June 2016 to January. The plaintiffs hold Stephan responsible because the defendant allegedly breached his bargaining agreement with the plaintiffs by failing to remit his contribution on behalf of his employees.
The plaintiffs seek principal amount of $59,109.48 plus interest and liquidated damages in the amount of $769.50, interest on the unpaid benefit contributions at the rate of 1.5 percent per month calculated to be $3,752.85, all legal fees and any other relief as the court deems just.
