Halcyon Horizons Inc. claims competitor is unlawfully using Elevate mark

SAN FRANCISCO – A Watsonville addiction recovery service alleges a competing recovery center has infringed its mark.

Halcyon Horizons Inc., doing business as Elevate Addiction Services, filed a complaint on April 5 in the U.S. District Court for the Northern District of California against Delphi Behavioral Health Group LLC, and Elevate Recovery LLC doing business as Elevate Recovery Center, alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Delphi Behavioral Health Group LLC and Elevate Recovery LLC responsible because the defendants allegedly caused confusion to its consumers as the result of using the Elevate mark.

The plaintiff requests a trial by jury and seeks to enjoin the defendants, damages, treble damages, punitive damages, all legal fees and any other relief as the court deems just. It is represented by Jennifer Seraphine, Zhuanjia Gu and Jacob Zweig of Turner Boyd LLP in Redwood City.
