SAN FRANCISCO – A Redwood City woman claims her disability benefits were wrongfully terminated.
Rebecca Stern filed a complaint on April 5 in the U.S. District Court for the Northern District of California against Life Insurance Co. of North America and the Wilson Sonsini Goodrich & Rosati Group Welfare Plan citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in 2011, she became disabled due to having been diagnosed with diabetes and other medical conditions and was initially approved to receive disability benefits. The suit states her benefits were terminated. The plaintiff holds Life Insurance Co. Group Welfare Plan responsible because the defendants allegedly failed to provide a prompt and reasonable explanation for the denial of her benefits and failed to investigate the merits of her claim.
The plaintiff seeks payment of disability benefits due to the plaintiff, reinstatement, payment of all past due benefits, injunctive relief, interest, all legal fees, and any other relief as this court deems just. She is represented by Glenn R. Kantor, Corinne Chandler and Andrew M. Kantor of Kantor & Kantor LLP in Northridge.
