Consumer files class against over alleged performance of Comcast modems

Consumer sues Comcast Corporation

SAN FRANCISCO — A consumer has filed a class-action lawsuit against Comcast Corporation, a Pennsylvania corporation, citing alleged negligent misrepresentation and unfair competition.

Jamie Trout filed a complaint on behalf of all others similarly situated on April 6, in the U.S. District Court for the Northern District of California against Comcast Corporation alleging that the Pennsylvania corporation made false representation to the consumers regarding the performance of their routers.

According to the complaint, the plaintiff alleges that she suffered damages from being misled into loaning a falsely advertised service. The plaintiff holds Comcast Corporation responsible because the defendant allegedly claims to be able to provide their customers high level of performance when in fact their consumers are getting subpar internet service.

The plaintiff requests a trial by jury and seeks order the defendant to engage in a corrective advertising, actual damages, full restitution, punitive damages, statutory enhanced damages, all legal fees, interest and any other relief as this court deems just.
