SAN FRANCISCO – A San Diego seller of diagnostic equipment is accused of offering an infringing product.
My Nemesis LLC filed a complaint on April 6 in the U.S. District Court for the Northern District of California against Edan USA Inc. and Does 1 to 100 alleging patent infringement.
According to the complaint, the plaintiff alleges that it owns patent '597, titled Apparatus, Device and Method for Obtaining Electrocardiogram. The plaintiff holds Edan USA Inc. and Does 1 to 100 responsible because the defendants' Patient Monitor iM80 allegedly infringes one or more claims of plaintiff's patents.
The plaintiff requests a trial by jury and seeks injunction against the defendants, compensate the plaintiff for all damages, all damages be trebled, order the defendant to deliver for destruction all products that infringes plaintiff's patents, all gains and profits, all legal fees and any other relief as this court deems just.
