My Nemesis alleges Tomtop Optical Fiber 2.4G Wireless headset infringes patent

SAN FRANCISCO – A San Jose company alleges a wireless headset for gaming systems infringes its patent.

My Nemesis LLC filed a complaint on April 6 in the U.S. District Court for the Northern District of California against Tomtop Group Limited and Does 1 to 100 citing patent infringement.

According to the complaint, the plaintiff alleges that it is the owner of the '004 patent, which is titled Fiber Optic Earpiece to Reduce Radiation Transmitted to a Cell Phone User. The plaintiff holds Tomtop Group Limited and Does 1 to 100 responsible because the defendants allegedly has knowledge of plaintiff's '004 patent but continued to manufacture and sell their Tomtop Optical Fiber 2.4G Wireless, which infringes at least one claim of plaintiff's patent.

The plaintiff seeks injunction against the defendants, enjoin the defendant, compensate the plaintiff for all damages, treble damages, order the destruction of all infringing products, gains, profits, advantages, all legal fees and any other relief as the court deems just. It is represented by Steven A. Nielsen of Nielsen Patents in Larkspur.
