Man seeks disability payments from Unum Life Insurance Co.

SAN FRANCISCO – A San Francisco County man alleges his benefits were wrongfully terminated.

Alex Lavita filed a complaint on April 5 in the U.S. District Court for the Northern District of California against Unum Life Insurance Co. of America alleging breach of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2003, he became disabled and was initially approved to receive disability benefits until the benefits were terminated in 2016. The plaintiff holds Unum Life Insurance Co. of America responsible because the defendant allegedly failed to render a decision on the plaintiff's appeal within 45 days after its submission and failed to provide and prompt and reasonable explanation.

The plaintiff seeks payment of disability benefits due to the plaintiff, continue to pay the plaintiff for as long as he remains disabled, all legal fees, interest and any other relief as the court deems just.
