Woman seeks payment of disability benefits from Life Insurance Co. of North America

SAN FRANCISCO – A Washington woman alleges she is disabled and that her insurer wrongfully denied her disability benefits.

Michele DeCamp filed a complaint on April 7 in the U.S. District Court for the Northern District of California against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2010, she became disabled and submitted an application for long-term disability benefits but was denied. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly denied plaintiff's claim based on its claim that her medical records and reported pain levels did not impact her functionality and she did not meet the definition of disability.

The plaintiff seeks payment of long-term disability benefits to the plaintiff plus interest, reinstatement into the plan, all legal fees, and any other relief as the court deems just. She is represented by Cassie Springer Ayeni and Claire Kennedy-Wilkins of Springer Ayeni in Oakland.
