SAN FRANCISCO – A Contra Costa County individual alleges a debt collector unlawfully contacted her.
Rosario Salinas filed a complaint on behalf of all others similarly situated on April 7 in the U.S. District Court for the Northern District of California against Stellar Recovery Inc. and Does 1-10 alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that she suffered damages from receiving several collection calls from the defendant beginning in January. The plaintiff holds Stellar Recovery Inc. and Does 1-10 responsible because the defendants allegedly kept on calling the plaintiff despite her request to stop calling her, called without her prior express consent and used an automatic telephone dialing system.
The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages, actual damages, all legal fees, and any other relief as the court deems just.
