Black Moon Cosmetics alleges logo, packaging designs were infringed

LOS ANGELES – A Burbank cosmetics company is accusing two individuals of unlawful business practices.

Black Moon Cosmetics filed a complaint on April 3 in the U.S. District Court for the Central District of California against the Manny Gutierrez, doing business as Manny Mua; Jeffree Star; and Jeffree Star Cosmetics alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Gutierrez, Star and Jeffree Star Cosmetics responsible because the defendants allegedly caused confusion among consumers by using a similar packaging design and logo as plaintiff's products.

The plaintiff seeks injunctive relief; disgorgement; all damages; interest; punitive, enhanced, and exemplary damages; economic and consequential damages; destruction of all infringing materials; all legal fees; and any other relief as this court deems just.
