Patagonia claims Kaleidoscope Custom Apparel and Design uses infringing mark

LOS ANGELES – A Ventura sportswear company alleges its trademark was unlawfully imitated by a Tennessee company

Patagonia Inc. filed a complaint on April 5 in the U.S. District Court for the Central District of California against David Groves, doing business as Kaleidoscope Custom Apparel and Design, alleging trademark infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of the unauthorized usage of its mark. The plaintiff holds Groves responsible because the defendant allegedly sells imitation products with the mark Chattagonia mark, which the plaintiff alleges mimics its Patagonia mark.

The plaintiff seeks enjoin the defendant, damages and lost profits, interest, treble damages, all legal fees and any other relief as the court deems just. It is represented by Gregory S. Gilchrist and Ryan Bricker of Kilpatrick Townsend & Stockton LLP in San Francisco.
