Consumers claim Fiat vehicle has engine, electrical defects

SAN FRANCISCO – Two Oakland individuals allege a vehicle they leased had defects.

Thomas Marsoner and Annabelle Darauya filed a complaint on March 28 in the San Francisco County Superior Court against FCA US LLC, HWM Auto Corp., doing business as McKevitt Fiat of Berkley, and Does 1 through 10 citing the Song-Beverly Act.

According to the complaint, the plaintiffs leased a new 2013 Fiat 500E in October 2013 and alleged the vehicle had engine and electrical system defects. The plaintiffs hold FCA US LLC, HWM Auto Corp. and Does 1 through 10 responsible because the defendants allegedly failed to repair the vehicle after a number of attempts.

The plaintiffs request a trial by jury and seek general, special and actual damages; rescission of the purchase contract; restitution; incidental and consequential damages; actual damages; interest; all legal fees; and any other relief as the court deems just.
