SAN DIEGO – A staffing company is accused of failing to pay overtime.
Loretta Jean Benson filed a complaint on behalf of others similarly situated on April 12 in the U.S. District Court for the Eastern District of California against Maxim Healthcare Services Inc. and Does 1 to 10 alleging violations of state labor codes.
According to the complaint, the plaintiff alleges that she was employed by the defendants from March to May 2015 and again from April to June 2016. The plaintiff holds Maxim Healthcare Services Inc. and Does 1 to 10 responsible because the defendants allegedly failed to pay overtime wages to the plaintiff and failed to pay wages that were owed at the time of termination.
The plaintiff requests a trial by jury and seeks unpaid overtime wages, general and special damages, interest, restitution, statutory waiting time penalties, all legal fees and any other relief as the court deems just.
