Woman alleges claim for disability benefits was unlawfully denied

SAN FRANCISCO – A Danville woman alleges her claim for disability benefits was wrongfully denied.

Brenda Spies filed a complaint on April 11 in the U.S. District Court for the Northern District of California against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she is disabled and was initially approved to receive disability benefits for 24 months. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld their decision to terminate plaintiff's disability benefits despite her meeting the definition of total disability under the terms of the plan.

The plaintiff seeks compensatory damages, all legal fees, interest and any other relief as the court deems just. She is represented by P. Randall Noah of Law Offices of P. Randall Noah in Orinda.
