Man files suit seeking benefits he alleges he is due from Life Insurance Co. of North America

LOS ANGELES – A former Veolia Energy North America employee alleges his disability benefits were wrongfully terminated.

David Wikstrom filed a complaint on April 11 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act. 

According to the complaint, the plaintiff alleges that in 2013, he became disabled due to a spine injury and was initially approved to receive disability benefits until it was terminated in 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant's denial is allegedly contrary to the terms of the plan.

The plaintiff seeks benefits due to the plaintiff plus interest, order that the defendant is entitled to future disability benefits, all legal fees and any other relief as the court deems just. He is represented by Frank N. Darras, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
