American Metal Fabricators LLC alleged to owe contributions to Carpenters Southwest Trusts

LOS ANGELES – A construction industry contractor is accused of failing to pay fringe benefit contributions to labor union funds.

Carpenters Southwest Administrative Corp. and board of trustees for the Carpenters Southwest Trusts filed a complaint on April 13 in the U.S. District Court for the Central District of California against American Metal Fabricators LLC, Earl Jerome Wallace, also known as Jerry Wallace, and Does 1 through 10 citing the Employee Retirement Income Security Act and the Labor-Management Relations Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late-paid contributions. The plaintiffs holds American Metal Fabricators LLC, Wallace and Does 1 through 10 responsible because the defendants allegedly breached their agreement with the plaintiffs by failing to make their contribution on behalf of their employees and for failing to pay a settlement that was reached in 2014.

The plaintiffs seek unpaid contributions of $8,621.68, interest, liquidated damages, audit costs, unpaid amounts of $24,861.04, interest, all legal fees, and any other relief as the court deems just. They are represented by Thomas Davis and Jodi Siegner of DeCarlo & Shanley in Los Angeles.
