Individuals allege Ford vehicle they purchased has defective transmission

SAN FRANCISCO – Two Oakland consumers allege a vehicle they purchased was defective and seek rescission of the purchase contract.

Matthew A. Hawes and Kristina M. Oates filed a complaint on March 30 in the San Francisco County Superior Court against Ford Motor Co. and Does 1 through 10 alleging breach of express warranty, fraudulent inducement and other counts.

According to the complaint, the plaintiffs allege that they purchased a new 2013 Ford Focus in 2013 with a defective DPS6 PowerShift transmission. The plaintiffs hold Ford Motor Co. and Does 1 through 10 responsible because the defendants allegedly knew of the defects of the transmission but failed to inform the plaintiffs of the said defects.

The plaintiffs seek general, special and actual damages, rescission of the purchase contract and restitution of all monies expended, incidental and consequential damages, actual damages, interest, injunctive and equitable relief, punitive damages, all legal fees and any other relief as the court deems just.
