Man alleges Chevrolet Colorado he purchased has defects, hasn't been repaired

FRESNO – A Fresno County consumer alleges he purchased a vehicle with defects and is seeking rescission of the sales contract.

Ken Lehman filed a complaint on April 4 in the Fresno County Supreme Court against General Motors and Does 1 through 20 citing the Song-Beverly Consumer Warranty Act.

According to the complaint, the plaintiff alleges that he suffered damages from purchasing a 2015 Chevrolet Colorado that had defects that manifested within the warranty period. The plaintiff holds General Motors and Does 1 through 20 responsible because the defendants, authorized repair facility allegedly failed and refused to repair the vehicle in order to bring it into conformity with the express warranties.

The plaintiff seeks rescission of the contract, actual damages, incidental and consequential damages, restitution of all monies paid, exemplary damages, all legal fees, interest and any other relief as the court deems just.
