Man alleges Chevrolet Cruze has defects

FRESNO – A Madera County consumer is seeking rescission of a Chevrolet vehicle he alleges has defects.

William Batt filed a complaint on April 5 in the Fresno County Superior Court against General Motors and Does 1 through 20 citing the Song-Beverly Consumer Warranty Act.

According to the complaint, the plaintiff alleges that he purchased a 2012 Chevrolet Cruze in 2012 and discovered the vehicle had defects while still within the warranty periods. The plaintiff holds General Motors and Does 1 through 20 responsible because the defendants' authorized service and repair facility allegedly failed to repair the defects on the plaintiff's vehicle.

The plaintiff seeks rescission of the contract, actual damages, incidental and consequential damages, restitution of all monies paid, exemplary damages, interest, all legal fees and any other relief as this court deems just.
