SAN FRANCISCO – A board of trustees for several labor union funds allege that certain employers have failed to submit to an audit.
The board of trustees for the Laborers Health and Welfare Trust Fund for Northern California; Laborers Pension Trust Fund for Northern California; Laborers Vacation- Holiday Trust Fund for Northern California and Laborers Training-Retraining/Apprenticeship Trust Fund for Northern California filed a complaint on April 19 in the U.S. District Court for the Northern District of California against The Brock Co.; The Brock Co., also known as The H.C. Brock Co; and The H.C. Brock Co. citing the Employee Retirement Income Security Act and breach of contract.
According to the complaint, the plaintiffs allege that they have been damaged by the defendants' actions. The plaintiff holds the defendants responsible because the defendants allegedly breached their bargaining agreement with the plaintiff by failing to pay their monthly contribution on behalf of their employees and failed, refused or neglected to allow an audit as requested.
The plaintiffs seek for the defendants to submit to a full audit, pay actual damages, injunction, enjoin the defendant, all legal fees, and any other relief as the court deems just.
