Capfusion alleged to have made unlawful marketing calls to Huntington Beach consumer

LOS ANGELES – A Huntington Beach man has filed a class action alleging a business funding lender called him without his permission.

Joseph Menichiello filed a complaint on behalf of all others similarly situated on April 19 in the U.S. District Court for the Central District of California against Capfusion LLC, Ryan Sullivan and Does 1 through 10 citing the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in February 2017, the defendants contacted him to solicit their services. The plaintiff holds Capfusion LLC, Sullivan and Does 1 through 10 responsible because the defendants allegedly used an automatic telephone dialing system to call the plaintiff and called without his consent.

The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages, and any other relief as the court deems just. He is represented by Todd M. Friedman, Adrian R. Bacon and Meghan E. George of Law Offices of Todd M. Friedman P.C. in Woodland Hills.
