LOS ANGELES – A Santa Ana consumer alleges an insurance company unlawfully called him for marketing purposes.

Frank Gutierrez filed a complaint on behalf of all others similarly situated on April 21 in the U.S. District Court for the Central District of California against Txen Partners LLC and Does 1 through 10 citing the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in December 2015, the defendants contacted him to solicit their services. The plaintiff holds Txen Partners LLC and Does 1 through 10 responsible because the defendants allegedly used an automatic telephone dialing system to call the plaintiff without his consent.

The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages, and any other relief as the court deems just. He is represented by Todd M. Friedman, Adrian R. Bacon and Meghan E. George of Law Offices of Todd M. Friedman P.C. in Woodland Hills.
