LOS ANGELES – A Los Angeles County individual claims that a debt collector has called her approximately 130 times since she asked it to stop.
Stephanie Villapando filed a complaint on May 24 in the U.S. District Court for the Central District of California, Western Division against Capital One Bank (USA) NA alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that she suffered damages from receiving several collection calls from the defendant. The plaintiff holds Capital One Bank (USA) NA responsible because the defendant allegedly kept on calling the plaintiff despite her request to stop calling.
The plaintiff seeks injunction against the defendant, $500 in statutory damages, treble damages of $1,500, all legal fees, interest and any other relief as the court deems just. She is represented by Matthew A. Rosenthal of Westgate Law in Los Angeles.
