LOS ANGELES – A Palmdale individual alleges a debt collector has caused her phone to ring repeatedly in an attempt to coerce her into paying a debt.
Patricia Martin filed a complaint on May 25 in the U.S. District Court for the Central District of California against Capital One Bank (USA) NA alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that beginning in 2016, she suffered damages from receiving several collection calls from the defendant. The plaintiff holds Capital One Bank (USA) NA responsible because the defendant allegedly kept on calling the plaintiff despite her request to stop calling her cellphone and for using an automated dialing system.
The plaintiff requests a trial by jury and seeks statutory damages of $1,000, actual damages, all legal fees, interest, and any other relief as the court deems just. She is represented by Stuart Price of Price Law Group APC in Encino.
