LOS ANGELES – Star Fabrics claims three of its designs were used without its permission.
Star Fabrics Inc. filed a complaint on May 26 in the U.S. District Court for the Central District of California against Ross Stores Inc., doing business as DD's Discounts; By Design LLC; Joyce Leslie Inc.; Ms. Bubbles Inc.; and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business from having three of its fabric designs copied without its permission. The plaintiff holds Ross Stores Inc., doing business as DD's Discounts; By Design LLC; Joyce Leslie Inc.; Ms. Bubbles Inc.; and Does 1 through 10 responsible because the defendants allegedly sold or manufactured garments made from fabric bearing plaintiff's designs.
The plaintiff requests a trial by jury and seeks to enjoin the defendants, statutory damages, all legal fees, interest and any other relief as this court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs and Howard S. Han of Doniger/Burroughs in Venice.
