LOS ANGELES – A Los Angeles corporation alleges a similar version of its copyrighted textile design was used in garments without authorization.
Star Fabrics Inc. filed a complaint on May 26 in the U.S. District Court for the Central District of California against Ross Stores Inc.; NB Brother Corp., doing business as Fancy Fans; Body Basics Stores Inc.; NNW Import Inc., and doing business as New Mix; and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages from having its design 64893 copied without its consent. The plaintiff holds Ross Stores Inc.; NB Brother Corp., doing business as Fancy Fans; Body Basics Stores Inc.; NNW Import Inc., and doing business as New Mix; and Does 1 through 10 responsible because the defendants allegedly sold or manufactured garments made out of fabrics that bear plaintiff's design.
The plaintiff requests a trial by jury and seeks enjoin the defendants, profits, statutory damages, all legal fees, interest, and any other relief as this court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs and Howard S. Han of Doniger/Burroughs in Venice.
