SAN DIEGO – An Emeryville business alleges that an insurance company unlawfully contacted it for solicitation purposes.
Abante Rooter and Plumbing Inc. filed a complaint on behalf of all others similarly situated on June 8 in the U.S. District Court for the Northern District of California against Nationwide Mutual Insurance Co. and Does 1 through 10 citing the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that beginning in 2016, Abante Rooter and Plumbing Inc. suffered damages from receiving several unwanted calls from the defendants in their attempt to solicit their services. The plaintiff holds Nationwide Mutual Insurance Co. and Does 1 through 10 responsible because the defendants allegedly used an automatic telephone dialing system to call the plaintiff. The plaintiff also alleges its number is registered on the National Do-Not-Call Registry.
The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages, and any other relief as this court deems just. It is represented by Todd M. Friedman, Adrian R. Bacon and Meghan E. George of Law Offices of Todd M. Friedman PC in Woodland Hills.
