LOS ANGELES – A Los Angeles company alleges one of its textile designs was used without permission.
Jitrade Inc. filed a complaint on June 7 in the U.S. District Court for the Central District of California against Lemon Tree Inc.; Eun Young Chung; Janne Walks Inc., doing business as 5th Culture and Simply 2 Fashion; Chingta Chen; Auditions Fashion Inc.; Sang Jin Park and Does 1-10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business from having its SND1604_6 design copied. The plaintiff holds Lemon Tree Inc.; Eun Young Chung; Janne Walks Inc., doing business as 5th Culture and Simply 2 Fashion; Chingta Chen; Auditions Fashion Inc.; Sang Jin Park and Does 1-10 responsible because the defendants allegedly sold or manufactured garments made out of fabrics that bear plaintiff's design.
The plaintiff requests a trial by jury and seeks enjoin the defendants, all profits, statutory damages, all legal fees, interest, and any other relief as the court deems just. It is represented by C. Yong Jeong and Amy J. Choe of Jeong & Likens LC in Los Angeles.
