IHSS homecare provider alleges she is owed unpaid overtime

LOS ANGELES – A homecare provider through the In-Home Supportive Services program alleges she is owed unpaid overtime wages.

Trina Ray filed a complaint on behalf of others similarly situated on June 7 in the U.S. District Court for the Central District of California against California Department of Social Services and Los Angeles County Department of Public Social Services citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked for more than 40 hours a week without being paid any overtime wages for the defendants as a homecare provider. The plaintiff holds California Department of Social Services and Los Angeles County Department of Public Social Services responsible because the defendants allegedly failed to pay overtime premiums to the plaintiff at a rate of time-and-one-half.

The plaintiff seeks unpaid back wages, unpaid wages owed, liquidated damages, penalties, interest, all legal fees and any other relief as the court deems just. She is represented by Matthew C. Helland and Daniel S. Brome of Nichols Kaster LLP in San Francisco.
