San Joaquin Valley Unified Air Pollution Control District files suit over alleged open burning violation

FRESNO – A pollution control district alleges that limited partnership in Fresno violated regulations regarding open burning.

San Joaquin Valley Unified Air Pollution Control District filed a complaint on May 16 in the Fresno County Superior Court against Poonia Family Limited Partnership and Amit Gill, doing business as Gill Operations, and Does 1-25 alleging that they violated the Health and Safety Code.

According to the complaint, the defendants unlawfully open burned paper raisin trays in October 2014 in violation of district rules.

The plaintiff requests a trial by jury and seeks civil penalty of $1,000, preliminary and permanent injunction enjoining defendants from engaging in any burning activity, award for costs of suit and such other and further relief. It is represented by Annette A. Ballatore-Williamson and Jessica E. Hafer Fierro of San Joaquin Valley Unified Air Pollution Control District.
