FRESNO – A Fresno County truck driver is suing The Papé Group Inc. and Does 1-20, former employers, citing alleged disability discrimination and wrongful termination.
Eddie Miranda filed a complaint on May 17 in the Fresno County Superior Court against The Papé Group Inc. and Does 1-20 alleging that they violated the Fair Employment and Housing Act.
According to the complaint, the plaintiff alleges that on Dec. 5, 2016, he was fired by the defendants because of his knee injury that he sustained while working in June 2015. The suit states that the plaintiff had filed a workers' compensation claim and was permitted to return to work with restrictions, but the plaintiff was told he could not work until he had no restrictions at all.
The plaintiff holds The Papé Group Inc. and Does 1-20 responsible because the defendants allegedly failed to provide reasonable accommodations, refused to engage in a good faith interactive process and did not allow him to return to work.
The plaintiff requests a trial by jury and seeks actual, special and general damages, pre- and post-judgment interest, attorney’s fees, costs and all other relief the court deems appropriate. He is represented by M. Greg Mullanax of Law Office. Greg Mullanax in Fresno.
