Man alleges Guardian Life Insurance Co. of America wrongfully withheld benefits

SAN FRANCISCO – A former Stratify employee alleges that his disability benefits were wrongfully withheld.

Ernest Tarasovsky filed a complaint on June 14 in the U.S. District Court for the Northern District of California against The Guardian Life Insurance Co. of America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he submitted a claim for disability benefits in March 2012 and that the defendant wrongfully denied his claim. After appeals and a suit in court, the defendant issued a check for benefits dating to February 2012 to the plaintiff. The plaintiff alleges that this caused him additional tax liabilities.

The plaintiff seeks interest on all long-term disability benefits, all legal fees and any other relief as the court deems just. He is represented by Richard Johnston of Johnston Law Office in Santa Rosa.
