JS Taylor Construction Inc. alleged to owe more than $5,000 for unpaid contributions

SAN FRANCISCO – A construction company is alleged to owe contributions to several labor union funds.

The board of trustees in their capacities as trustees of the Laborers Health and Welfare Trust Fund for Northern California, et al. filed a complaint on June 15 in the U.S. District Court for the Northern District of California against JS Taylor Construction Inc. citing the Employee Retirement Income Security Act and the Labor Management Relations Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid contributions. The plaintiffs hold JS Taylor Construction Inc. responsible because the defendant allegedly breached their bargaining agreement with the plaintiff by failing to pay its contribution on behalf of its employees.

The plaintiffs seek contributions of $5,265.36 plus interest; liquidated damages in the amount of $1,540.93 plus interest; contributions for hours that were not reported of $5,321.20; actual damages; order the defendant to submit to an audit; all legal fees; and any other relief as the court deems just. They are represented by Barry E. Hinkle, Concepcion E. Lozano-Batista, Tracy L. Mainguy and Ryan B. Kadevari of Weinberg, Roger & Rosenfeld in Alameda.
