Union trust funds accuse Associated Air Balance and Certification of breaching agreement

SAN FRANCISCO – A California corporation is accused of breaching a bargaining agreement for its alleged failure to allow an audit of its payroll records.

Boards of trustees of the Sheet Metal Workers Pension Trust of Northern California, et al. filed a complaint on June 16 in the U.S. District Court for the Northern District of California against Associated Air Balance and Certification Inc. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that the defendant has failed and refused to pay liquidated damages on late-paid contributions for April and August 2015 and refused to comply with an audit of its payroll records. The plaintiff alleges this is a breach of their bargaining agreement.

The plaintiffs seek to enjoin the defendant, unpaid contributions, liquidated damages, interest, all legal fees and any other relief as the court deems just. They are represented by Michele R. Stafford and Matthew P. Minser of Saltzman & Johnson Law Corp. in San Francisco.
