LOS ANGELES – A Los Angeles County company claims one of its textile designs was unlawfully used for clothing.
Fabric Selection Inc. filed a complaint on June 14 in the U.S. District Court for the Central District of California against Fab Mill Inc., Hearts of Palm LLC, Alfred Dunner Inc., Belk Inc., Dillard's Inc., Von Maur Inc. and Does 1 through 20 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages from having its SE30962 fabric design copied. The plaintiff holds Fab Mill Inc., Hearts of Palm LLC, Alfred Dunner Inc., Belk Inc., Dillard's Inc., Von Maur Inc. and Does 1 through 20 responsible because the defendants allegedly sold or manufactured garments made out of fabrics that feature plaintiff's design.
The plaintiff seeks injunction against the defendants, the recall and destruction all infringing garments, profits, statutory damages of $150,000, all legal fees and any other relief as the court deems just.
