LOS ANGELES – A Los Angeles County company alleges that two New York individuals copied a design to use on a shirt.
Lauren Moshi LLC filed a complaint on June 14 in the U.S. District Court for the Central District of California against Susan Silverstein, Kim Spellman, both individually and doing business as Flowers by Zoe Inc., and Does 1 through 50 alleging copyright infringement.
According to the complaint, the plaintiff is the author and copyright owner of a print known as "Good Vibes Girl." The plaintiff holds Silverstein, Spellman, both individually and doing business as Flowers by Zoe Inc., and Does 1 through 50 responsible because the defendants allegedly pirated the plaintiff's design for use on a T-shirt.
The plaintiff requests a trial by jury and seeks injunction against the defendants, recall and destruction of all infringing garments, profits, statutory damages of $150,000, all legal fees and any other relief as the court deems just.
