SAN FRANCISCO – A Santa Clara corporation is accused of unlawfully reproducing and distributing exam questions.

Examinations Institute of the American Chemical Society, Division of Chemical Education filed a complaint on June 19 in the U.S. District Court for the Northern District of California against Chegg Inc. alleging copyright infringement and other counts.

According to the complaint, the defendant offers exam question answers to students who upload photos of the exam questions. The suit states the defendant later uses these photos to create unlawful derivative works.

The plaintiff holds Chegg Inc. responsible because the defendant allegedly infringed the plaintiff's copyrights in its secure examinations and study guides.

The plaintiff requests a trial by jury and seeks all damages, disgorgement, profits, statutory damages, injunctive relief, treble damages, removal of all infringing content and the destruction of all infringing materials, restitution, all legal fees, and any other relief as the court deems just. It is represented by Morgan E. Smith of Finnegan, Henderson, Farabow, Garrett & Dunner LLP in Palo Alto.
