Vortex Marine Construction Inc. alleged to owe employee contributions

SAN FRANCISCO – A California corporation is accused of failing to pay employee contributions to labor union groups.

Operating Engineers' Health and Welfare Trust Fund for Northern California, et al. filed a complaint on June 22 in the U.S. District Court for the Northern District of California against Vortex Marine Construction Inc., doing business as Vortex Diving Inc., citing the Employee Retirement Income Security Act.

According to the complaint the plaintiffs allege that they have suffered damages due to unpaid and late-paid contributions. The plaintiffs holds Vortex Marine Construction Inc. responsible because the defendant allegedly failed to pay contributions for its employees from August 2016 to April 2017 and late-paid contributions are owed from previous years.

The plaintiffs seek unpaid contributions, liquidated damages, interest, all legal fees, enjoin the defendant and any other relief as the court deems just. They are represented by Michele R. Stafford and Matthew P. Minser of Saltzman & Johnson Law Corp. in San Francisco.
