SAN FRANCISCO – A Union City company alleges that two New York companies have infringed its trademark.
La Terra Fina USA LLC filed a complaint on June 22 in the U.S. District Court for the Northern District of California against TerraFina LLC and Cormorant Group LLC alleging trademark infringement, breach of contract, fraud and other counts.
According to the complaint, the plaintiff and the defendants all market food products and that the parties entered into a settlement agreement in 2010 that prohibited Cormorant from using the TerraFina mark on chips, dried or raw veggies or dips.
The plaintiff holds TerraFina LLC and Cormorant Group LLC responsible because the defendants allegedly sold veggie chips using the TerraFina trademark in violation of their settlement agreement.
The plaintiff seeks injunctive relief, order the defendants to deliver all goods bearing the TerraFina name, compensatory damages, statutory damages of up to $100,000 for each trademark infringement and up to $1 million for each willful trademark infringement, all legal fees, punitive damages and any other relief as this court deems just.
