LOS ANGELES – An Oceanside company one of its patents is being infringed by a cotton candy machine sold at Walmart stores.
Glo Cone International LLC filed a complaint on June 20 in the U.S. District Court for the Central District of California, Western Division against Larose Industries LLC, Cra-Z-Art Corp. LLC Wal-Mart Stores Inc., and Does 1-10 alleging patent infringement.
According to the complaint, the plaintiff alleges that it is the owner of the Handheld Illuminated Apparatus for Retaining a Food Item in an Edible Condition with the Illumination Directly Passing Through the Food Item patent.
The plaintiff holds Larose Industries LLC, Cra-Z-Art Corp. LLC, Wal-Mart Stores Inc. and Does 1-10 responsible because the Cra-Z-Art Light Up Candy Wand allegedly infringes the plaintiff's patent and that the wands are sold in Walmart stores.
The plaintiff requests a trial by jury and seeks lost profits, to enjoin the defendants, deliver up all infringing products, all legal fees, disgorgement and/or restitution, enhanced damages, interest and any other relief as the court deems just.
