Man files suit over termination of disability benefits by Life Insurance Co. of North America

LOS ANGELES – A man alleges that his insurer ignored the opinions of his physicians with its denial of his disability benefits.

John Cheak filed a complaint on June 22 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled and received disability benefits from the defendant for five years before the benefits were terminated. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly terminated plaintiff's disability benefits despite having sufficient medical proof to support his claim.

The plaintiff seeks award benefits to the plaintiff plus interest, all legal fees and any other relief as the court deems just. He is represented by Frank N. Darras, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
