More than $80,000 sought from JD4 Plumbing after it allegedly failed to complete work

FRESNO – A Fresno general contractor alleges a subcontractor failed to complete work it was hired to do.

Robert Managing Contractors Inc., doing business as RMC Constructors, filed a complaint on June 7 in the Fresno County Superior Court against JD4 Plumbing Inc., Joseph Dagnino III (alter ego of JD4) and Does 1-25 alleging breach of contract.

According to the complaint, the plaintiff subcontracted the defendants for a Sacramento construction project in November 2016. The plaintiffs holds JD4 Plumbing Inc., Dagnino III and Does 1-25 responsible because the defendants allegedly failed to perform the scope of work on the project and refused to finish the project. The plaintiff alleges it was forced to hire a new subcontractor to complete the work.

The plaintiff seeks damages in an amount not less than $82,314.24, plus interest, attorneys' fees and costs and such other just and proper relief. It is represented by David L. Emerzian of McCormick, Barstow, Sheppard, Wayte & Carruth LLP in Fresno.
