Valero Refining alleges Pacific Gas & Electric Co. power loss at refinery cost revenues

SACRAMENTO – Valero Refining Co. alleges a power loss earlier this year cost it revenues.

Valero Refining Co. filed a complaint on June 30 in the U.S. District Court for the Eastern District of California against Pacific Gas & Electric Co. alleging breach of contract, negligence and other counts.

According to the complaint, on May 5, the plaintiff lost electrical power at its Benicia refinery, which caused an emergency shutdown. The plaintiff alleges the refinery remained out of service for a period of time, which deprived it of revenues and caused fuel supply disruptions in Northern California. 

The plaintiff holds Pacific Gas & Electric Co. responsible because the defendant allegedly breached their contractual duty to the plaintiff by failing to prevent electric disruption to the plaintiff's refinery.

The plaintiff seeks damages, restitution, punitive and exemplary damages, all legal fees and any other relief as this court deems just. It is represented by John Cox, Nathan R. Jaskowiak and Alexander J. Bukac of Keesel, Young & Logan in San Francisco.
