LOS ANGELES – A dissolved California corporation is alleged to have failed to pay a withdrawal liability to a labor union fund.
GCIU-Employer Retirement Fund and board of trustees of the GCIU-Employer Retirement Fund filed a complaint on June 27 in the U.S. District Court for the Central District of California, Western Division against All West Container Co. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the defendant withdrew from participating in the plaintiffs' funds in 2011 and was provided a notice of complete withdrawal and demand for payment in May 2012. They allege the payment is still due and owing.
The plaintiff seeks past due withdrawal liability payment of $310,551.40, interest, liquidated damages, all legal fees and any other relief as the court deems just. They are represented by Kerry K. Fennelly and Valentina S. Mindirgasova of Cornwell & Baldwin in Escondido.
